Prawne niuanse

Kontrolę prawną nad funkcjonowaniem DPS stanowi Ustawa z dnia 12 marca 2004 r. o pomocy społecznej, której zapisy regulują zadania w zakresie pomocy społecznej, rodzaje świadczeń z pomocy społecznej oraz zasady i tryb ich udzielania, organizację pomocy społecznej, zasady i tryb postępowania kontrolnego w zakresie pomocy społecznej.

DZIAŁ II Ustawy – Świadczenia z pomocy społecznej, rozdział 2 – Domy Pomocy Społecznej (art. 54 – 66) reguluje zasady związane w funkcjonowaniem DPS, zarówno od strony organizatora, jak i ubiegającego się.
